These Terms of Use ("Terms") apply to the EZ Mile Log app for iPhone and Android and to this website, provided by Batishev Enterprises LLC ("we", "us"). Before using EZ Mile Log, you must review and accept these Terms in the app. If you do not agree, do not use EZ Mile Log.
1. What EZ Mile Log is
EZ Mile Log is a record-keeping tool. It helps you log trips (automatically, with a start and stop button, or by hand), mark them business or personal, log expenses with receipt photos, and make reports. For trips you mark as business, medical or charity, it shows a value using the IRS standard mileage rate in effect on each trip's date, as published by the IRS.
2. Not tax, legal or accounting advice
EZ Mile Log does not give tax, legal or accounting advice and does not decide what you can deduct or claim. The value it shows is a calculation (miles multiplied by a published rate), not a statement that you are entitled to a deduction or reimbursement. Whether and how you can claim mileage or expenses depends on your own situation and the law; ask a qualified tax professional. Mileage values in the app do not establish that you are eligible for a deduction, which accounting method you may use, or that your records meet any recordkeeping requirement. EZ Mile Log is not affiliated with, endorsed by or connected to the Internal Revenue Service or any government agency, and nothing in the app is "IRS-approved".
3. Your records are your responsibility
- You are responsible for the accuracy and completeness of everything in your log, including the purpose of each trip, its distance and dates, and every expense.
- Review automatically detected trips. GPS and phone motion sensors are not perfect: trips can be missed, split, or measured a little long or short, especially with weak signal, low battery, battery-saving modes, or location access turned off.
- Trips you type in and trips you edit are your own entries; they are not independently verified. If you change a distance the app recorded, the report and spreadsheet show that it was edited. Reports are your records, not certified evidence of travel.
- Use EZ Mile Log only to keep honest and accurate records. Do not create, inflate, alter or submit false, fabricated or misleading trips, distances, purposes, expenses or receipts. You are responsible for reviewing and correcting your records, including automatically recorded trips, before using them for taxes, reimbursement or any other purpose.
- We do not independently review, verify, audit, certify, file or submit your mileage or expense records to the IRS, any other tax authority, an employer or anyone else on your behalf. We do not determine whether a trip actually occurred, whether a distance or purpose is accurate, or whether a deduction or reimbursement is allowable. You decide what to report and are responsible for the claims and representations you make using your records. To the maximum extent permitted by law, we are not responsible for taxes, penalties, interest, disallowed deductions, repayment demands, audit expenses or other consequences resulting from your false, inaccurate, incomplete or misleading entries, classifications or submissions. This provision does not exclude or limit liability for our own conduct where applicable law prohibits such exclusion or limitation.
4. Rates
The app includes the IRS standard mileage rates published as of the version you are using. Rates can change, including during a year. When a trip falls after the last date the app's rate table covers, the app says so on the report. Always confirm current rates at irs.gov.
5. Safe driving
Never interact with the app while operating a vehicle. Start and end trips, and sort or edit them, only when safely parked, or set up automatic logging before you drive. Obey all traffic and phone-use laws.
6. Your data and backups
Your log is stored on your phone, not on our servers. We cannot see it and cannot recover it for you. If you delete the app, lose or reset your phone, or your phone's storage fails, your log can be lost unless you have saved a backup. Please use the app's "Save a backup file" option regularly and keep the file somewhere safe. To the maximum extent permitted by law, we are not responsible for lost data.
EZ Mile Log does not transmit your trip or expense records to Batishev Enterprises LLC, and we do not independently maintain copies of your log. If you voluntarily send us records, screenshots, reports or backup files for support, we may receive that information as described in our Privacy Policy. We do not independently authenticate or certify information you send us. We may comply with valid subpoenas, court orders, tax summonses or other legal obligations involving information actually in our possession. Nothing in these Terms requires us to maintain independent copies of your records or provide verification that any recorded trip or expense actually occurred.
7. Battery and location
Automatic logging uses your phone's location and motion features in the background. Location and motion services may run before, during and shortly after a drive, to notice that you are traveling, measure the distance and tell when the trip has ended. Battery use varies by phone and settings. Automatic recording needs the right permissions and may stop or miss trips without warning, for example if permissions are changed, the phone restarts or a battery saver limits background activity. You can turn automatic logging off at any time in the app's Settings and still log trips with the Start button or by hand.
8. Purchases and refunds
EZ Mile Log is a paid download with a one-time price. There is no subscription. Apple (App Store) and Google (Google Play) process all payments, and refunds are governed by their policies and by applicable consumer law. iPhone customers can request a refund at reportaproblem.apple.com. Google Play customers can request a refund through Google Play or by contacting us. If something isn't working, email [email protected] and we'll help. Purchases do not transfer between Apple and Google accounts.
9. Provided "as is"
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZ MILE LOG IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. We do not warrant that the app will detect every trip, measure every distance exactly, or be error-free or uninterrupted.
10. Limit of our liability
TO THE EXTENT PERMITTED BY LAW, BATISHEV ENTERPRISES LLC EXCLUDES LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND FOR ANY TAXES, PENALTIES, INTEREST, DISALLOWED DEDUCTIONS, AUDIT COSTS, LOST REIMBURSEMENTS, LOST DATA OR LOST TIME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO EZ MILE LOG IS LIMITED TO THE AMOUNT YOU PAID FOR EZ MILE LOG. These limitations apply only to the extent permitted by applicable law. They do not apply to fraud, gross negligence, willful misconduct, or any other liability that cannot lawfully be excluded or limited.
11. Your responsibility to us
To the extent permitted by applicable law, you agree to indemnify and hold harmless Batishev Enterprises LLC and its owners, members, managers, employees and agents against reasonable losses, damages, liabilities and legal expenses arising from third-party claims against them, but only to the extent directly caused by:
- (a) your knowing creation, falsification or submission of materially false or fraudulent mileage or expense records using EZ Mile Log;
- (b) your knowing misrepresentation that Batishev Enterprises LLC verified, approved, certified or submitted your records; or
- (c) your unlawful use of EZ Mile Log while operating a vehicle.
This obligation does not apply to good-faith recording errors, claims you bring against us, or losses caused by our own acts or omissions. It does not require you to assume any liability that cannot lawfully be transferred to you. We will provide reasonably prompt notice of a covered third-party claim and a reasonable opportunity for you to participate in its defense. We will not settle a claim in a manner that imposes a payment obligation or admission of wrongdoing on you without your prior written consent.
12. Apple and Google
For iPhone users, Apple's Standard Licensed Application End User License Agreement (EULA) governs your license to use the app, and these Terms are supplemental to it. These Terms are between you and Batishev Enterprises LLC, not Apple or Google. Apple and Google are not responsible for EZ Mile Log or its content, have no obligation to provide support for it, and are not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms for iPhone users and may enforce them. Your use of the app must also follow the App Store or Google Play terms.
13. Changes and governing law
We may update these Terms going forward. The current version will always be on this page with its effective date, and material changes will be noted in the app or another appropriate way. Changes do not take away rights you already have. These Terms are governed by the laws of the State of Washington, United States, except where mandatory consumer protections require otherwise.
14. Disputes
Before filing a civil lawsuit relating to EZ Mile Log, the parties agree to make a good-faith effort to resolve the dispute informally. You may send a description of your dispute and the resolution requested to [email protected]. If we initiate a dispute, we will provide notice using contact information you have made available to us. The parties will allow 30 days after receipt of notice to attempt resolution.
This process does not prevent either party from bringing an eligible small-claims action, seeking urgent court relief, preserving a claim before a legal filing deadline, contacting a government agency or exercising any right that cannot lawfully be restricted.
If a dispute is not resolved, it may be brought in any court having jurisdiction and proper venue under applicable law. Neither party is required to arbitrate. Nothing in these Terms waives any right to bring or participate in a class or representative proceeding where permitted by law.
15. Other terms
Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Entire agreement. These Terms, together with applicable App Store or Google Play license and purchase terms, constitute the agreement concerning your use of EZ Mile Log, subject to any rights or obligations that cannot lawfully be modified. Apple's Standard EULA continues to govern the iPhone app license as described above. Our Privacy Policy separately describes our information practices and is not intended to limit your rights under applicable privacy laws.
No waiver. Our failure or delay in enforcing any provision of these Terms does not waive our right to enforce that provision later.
